The State of Alabama has recently introduced a series of new laws that are reshaping the landscape of smoking and vaping regulations. The Ban on Smoking and Vaping in Vehicles

It doesn’t matter if the vehicle is stationary or in motion, or if the windows are rolled down – the prohibition stands. Violators of this law could face fines of up to $100, emphasizing the state’s commitment to protecting its younger population.
A Closer Look at Vaping Laws
Beyond the vehicle-related ban, Alabama has also put in place several other vaping-related regulations. These new laws, outlined in Ala. Code § 28-11-13(a) (2023), touch upon various aspects of vaping, ensuring a comprehensive approach to curbing its use among young individuals.
Age of Consent and Retail Restrictions
Alabama has taken a strong stance on preventing youth access to vaping products. The sale, purchase, and possession of electronic nicotine delivery systems by individuals under 21 years of age are strictly prohibited. Furthermore, specialty retail licenses for electronic nicotine delivery systems are off-limits within 1,000 feet of locations frequented by young people, such as schools, child-care facilities, and playgrounds.
Advertising and Marketing Limitations
In an effort to curb the allure of vaping to the younger population, Alabama law restricts advertising and marketing tactics. Manufacturers and retailers are barred from using product names for scholarships or events that don’t predominantly involve individuals aged 21 and older. Advertising in publications where the majority of readers are under 21 is also prohibited, as is promoting vaping flavors other than tobacco, mint, or menthol within a certain distance from schools and public playgrounds.
Delivery Sales Regulations
The state has also tightened the regulations surrounding the online sale and delivery of vaping products. Deliveries are only allowed after thorough age and address verification, with payment being accepted exclusively through the purchaser’s credit or debit card.

As the academic year begins, a notable concern is the prevalence of vaping on school campuses. Authorities are expected to intensify crackdowns on vaping within educational institutions, aiming to create a healthier environment for students.
