New regulations for vaping products have taken effect in Arkansas, with further restrictions scheduled for November. As of September 1st, vape sellers are now prohibited from marketing their products in ways that may appeal to minors. This includes banning flavors that imitate food brands and the use of fictional characters from TV, movies, or comic books in promotional materials.
Additionally, vaping is now officially banned in all schools, healthcare facilities, and childcare facilities across the state. A more significant change will occur on November 1st, when it will become illegal to sell or possess (for sale) any vape devices that are not included on a specific product directory created by the Director of Arkansas Tobacco Control. The initial version of this list, based on products with FDA approval or pending approval, was released on August 28th and includes thirteen brand families. The commission plans to update this approved product list several times before and after the November deadline.
