A new bill in the Kentucky House of Representatives seeks to tighten regulations on the sale of vapes and e-cigarettes within the state. House Bill 11, if passed, would restrict retailers to selling only those smokeless nicotine products that have been approved for marketing by the Food and Drug Administration (FDA).
Targeting Products Appealing to Youth
The primary focus of the bill is on e-cigarettes and vapes that feature enticing fruit flavors and vibrant packaging, which are often deliberately designed to attract young people. According to the bill’s sponsors, many of these products lack the necessary clearance to be legally sold on store shelves.
State Representative Rebecca Raymer, R-Morgantown, emphasized that a significant number of e-cigarettes and vapes currently sold in Kentucky and throughout the country are being offered without proper FDA authorization. “The FDA has a very limited enforcement arm and so we as a state have an obligation to offer some public protection to our citizens,” Raymer stated.
Requiring FDA Authorization for Sale
Under House Bill 11, stores would be permitted to sell only those smokeless nicotine products that have either received FDA authorization or have applied for such authorization. Many of the colorful vapes boasting “fun” flavors have already been denied FDA clearance for sale.
Raymer revealed that she was contacted by school officials in her district, as well as other representatives, regarding the prevalence of vaping among students. “As I dove into what was being confiscated are mostly flavored and disposable vapes,” she added.
Alarming Vaping Statistics Among Kentucky Youth
A recent Kentucky Incentives for Prevention survey highlights the gravity of the situation, reporting that over 26% of high school seniors and 5% of 6th graders have vaped in the past year. In addition to regulating the types of products that can be sold, House Bill 11 also aims to strengthen penalties for stores caught selling unauthorized products or any products to individuals under the age of 21.
The bill mandates the creation of a database by the state’s Department of Alcohol and Beverage Control, which would list noncompliant stores. Any store found on this database would be prohibited from purchasing additional vaping products.
Health Concerns and Opposition from Vape Store Owners
Dr. Brit Anderson, a pediatric emergency medicine physician, highlighted the health risks associated with vaping, including lung injury and altered brain development during adolescence. “It breaks my heart to see young people already addicted to nicotine products,” Anderson remarked.
However, some vape store owners expressed concerns that the bill could potentially force them out of business. Tommy Wilson, who owns two vape stores in Pulaski County, acknowledged the issue of youth vaping but argued that most vape store owners establish their businesses to help people quit traditional cigarettes. He and other vape store owners present at the committee meeting attributed the majority of the youth vaping problem to convenience stores.
Wilson, while not in strong opposition to the bill, suggested that it could be amended to allow the sale of ‘fun and fruity’ products exclusively in stores that only admit customers 21 and older. “We feel like it’s an adult’s choice to be able to find something that they deem is less harmful to their body; is it perfect? Maybe not, but is it better than 3,000 chemicals and smoke going into your lungs? I feel it is,” Wilson asserted.
Bill Passes Committee with Penalties for Violations
House Bill 11 passed the committee favorably, with 14 votes in favor, one against, and three abstentions. Under the proposed legislation, retailers found selling unauthorized products to any person would face a $1,000 fine for the first violation and $5,000 for each subsequent violation.
As the bill moves forward, it remains to be seen how it will balance the need to protect public health, particularly that of youth, with the concerns of vape store owners who view their products as a less harmful alternative to traditional cigarettes.
