Age Discrepancy Between State and Federal Law
While the legal age to purchase nicotine in South Carolina is currently 18, federal law still mandates a minimum age of 21. This discrepancy has raised concerns among lawmakers who believe that the state should be doing more to discourage vaping, particularly among minors.

During a recent Medical Affairs Committee meeting, senators expressed support for the bill but also emphasized the need to find a balance between regulating incoming products and allowing local tobacco farmers to maintain their livelihoods. Senator Matt Leber, R-District 41, highlighted the importance of taking care of minors while also supporting legitimate adult businesses in South Carolina.
Leveling the Playing Field for Local Producers
Lawmakers hope that Bill 287 will bring state oversight to help regulate imported devices from countries like China, which may not have the same stringent regulations as the United States. By ensuring that all products meet FDA standards, the bill aims to level the playing field for local producers. Senator Josh Kimbrell, R-District 11, voiced his support for the bill but stressed the importance of not shutting down law-abiding citizens who operate in South Carolina.
