The South Korean Ministry of Health and Welfare has officially enacted an amendment classifying all nicotine vaping liquids as tobacco products. This legislative shift directly subjects e-cigarettes to the nation’s strict smoking bans and retail restrictions, aiming to curb rising vaping rates.
The newly enforced amendment to the Tobacco Business Act closes a major regulatory loophole. Previously, the legal definition of tobacco was limited to products made directly from tobacco leaves. Now, the law explicitly includes products manufactured with any form of tobacco or nicotine, heavily targeting synthetic nicotine liquids that previously evaded oversight.
For both consumers and business owners, the regulatory changes introduce immediate, sweeping restrictions:
- Public Use Penalties: Vaping is strictly prohibited in all no-smoking areas, including public facilities, restaurants, and transit stations. Violators face fines of up to 100,000 won (approximately $72).
- End of In-Store Sampling: Vape shops are no longer allowed to let customers test devices or flavors inside the store before purchasing.
- Advertising and Sales: Visible exterior advertising is banned. Furthermore, vending machines can only be installed in authorized, age-restricted locations.
- Packaging Mandates: Mandatory graphic and textual health warnings must now appear on all nicotine vaping products.
The retail sector is already bracing for the economic impact. A Seoul vape shop manager, speaking anonymously to EFE, predicted a market downturn, noting that the ban on in-store sampling removes a key driver for customer purchases.
Public awareness of the sudden shift remains mixed. While one office worker admitted to being unaware of the new law while vaping in a public zone, a colleague supported the measure, stating, “At the end of the day, it’s a type of tobacco, contains nicotine, and harms the health of others.”
This regulatory tightening aligns with shifting nicotine consumption habits in South Korea. According to a late-2025 study by the Korea Disease Control and Prevention Agency (KDCA), e-cigarette adoption is climbing even as traditional smoking declines.
